FACTORS OR CAUSES OF TRAFFIC ACCIDENTS
YOU NEED TO KNOW THE DIFFERENCE BETWEEN DIRECT OR INDIRECT CAUSES OF A TRAFFIC ACCIDENT
In every traffic accident, once it has occurred, it is necessary to analyze and investigate the factors and causes by which it may have happened, distinguishing generically between direct and indirect causes. In fact, in many certificates that are made for the same reason, these expressions are contained, it being relevant to know their meaning and their importance to determine who is responsible for an accident and if he can be considered the only one guilty or there is a concurrence of guilt that will have to be specified later.
The indirect or mediate cause of an accident is that which participates in its occurrence, even if it is not the cause of the accident itself, and refers to both the vehicle, the road, and the driver or pedestrian.
With respect to the vehicle, inadequate maintenance results in the poor operation of the vehicle, especially if it affects safety, such as the brakes or tires; or excessive power that allows driving at inappropriate speeds, among many others.
Regarding the road and atmospheric conditions, we would say that it is an indirect cause of an accident when it has a poor route or a lack of or incorrect signage, or its pavement is in a bad state of conservation. Also when visibility can be reduced due to fog or rain, or the pavement can be slippery as a result of the above climatological factors or others such as spills.
Regarding the driver or pedestrian, the physical impairments thereof, the accumulation of fatigue (long journeys), mental impairments for various reasons, lack of knowledge and expertise for the condition of a specific vehicle, insufficient knowledge of traffic signals, etc., can also be considered indirect or mediated causes of the accident.
The direct or immediate cause is that which directly intervenes in the accident and is considered the factor that could have prevented it, being in the vast majority of cases imputable to the person who intervened. Among the most frequent are:
- Inadequate speed, distractions, and violations.
- Deficiencies or delays in risk perception.
- The errors in the maneuvers carried out to avoid the danger.
